The present general conditions of sale govern all relations between MCCP Distribution SARL, publisher of the Site, and its customer, the parties accepting them without reservation. The customer acknowledges having read these terms and conditions prior to placing an order. He expressly declares that he accepts them without reservation.
The order is placed by the customer on the MCCP Distribution SARL website. A firm order with no possibility of cancellation is placed when the customer presses the “Confirm order” button on the confirmation page. By placing an order, the customer makes an offer to purchase the products selected on www.particulier.mccpcoiffure- bio.ch. MCCP Distribution SARL reserves the right to accept or decline this offer at its discretion. MCCP Distribution SARL will confirm acceptance of the order to the customer by e-mail within 24 hours to the address provided at the time of registration; the order is then effective, the e-mail sent by MCCP Distribution SARL forming a sales contract between the customer and MCCP Distribution SARL. The order can only be processed by MCCP Distribution SARL after payment of the products by the customer (i.e. as soon as MCCP Distribution SARL has received confirmation that the payment has been validated by Mastercard, VISA, Postcard, TWINT) MCCP Distribution SARL reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order, or if MCCP Distribution SARL reasonably believes that the customer has violated these terms and conditions, or has engaged in fraudulent activity, or has refused to provide MCCP Distribution SARL with any useful or necessary information to enable secure payment and delivery of the products. MCCP Distribution SARL cannot be held responsible for the impossibility of delivering the product in the event of an error in the recipient's contact details. In the event of delivery problems from the manufacturer (availability), MCCP Distribution SARL will endeavour to find an alternative solution in agreement with the customer and to the customer's advantage. By placing an order, the customer certifies that he/she is 18 years of age or older.
The information, photographs and illustrations relating to the products and appearing on the pages of the Site have no contractual value and cannot engage the responsibility of MCCP Distribution SARL in any way whatsoever. Technical information and links are provided for information purposes only and do not engage the responsibility of MCCP Distribution SARL in any way whatsoever. The technical specifications and/or content of the products delivered may differ from the data supplied by the manufacturer or displayed on its website. The customer undertakes to comply scrupulously with the instructions and recommendations for use and storage of the products. MCCP Distribution SARL cannot be held responsible for the use or storage of products in conditions that do not comply with the relevant instructions and recommendations.
Prices are in Swiss francs. The prices indicated on the pages include VAT (8.1%). The price invoiced to the customer is the price indicated on the order confirmation, plus shipping costs. The prices indicated on the order confirmation are binding, even in the event of variations between the order date and the date of delivery of the goods. In the event of a price error on a product, MCCP Distribution SARL reserves the right to modify this price, offering the customer the option of cancelling the order if the new price does not suit him/her. MCCP Distribution SARL reserves the right, which the customer accepts, to modify prices at any time, without any further formality other than posting the modifications on the site. However, such changes will not affect orders confirmed by MCCP Distribution SARL prior to the entry into force of the changes, subject to the availability of the products ordered.
Shipments are sent by Post (Postpac Priority). A fixed delivery charge of CHF 9.90 exclusive of VAT applies. Liability of MCCP Distribution SARL The present “Terms of Use” determine all obligations and responsibilities of MCCP Distribution SARL concerning the supply of products. MCCP Distribution SARL is not bound by any other warranties, conditions or other provisions, except those expressly mentioned in this contract. MCCP Distribution SARL shall not be liable under this agreement for any loss of revenue, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind whatsoever arising out of or caused by tort (including negligence), breach of contract or otherwise. MCCP Distribution SARL will use its best efforts to fulfill its obligations under this agreement. However, MCCP Distribution SARL shall not be liable for any loss or damage suffered by the customer arising from its delay in performing any of its obligations or its failure to perform any or all of its obligations under the contract, where such delay or failure is due to a circumstance beyond its control. In the event of delay, MCCP Distribution SARL undertakes to remedy the situation and perform its obligations as soon as possible. MCCP Distribution SARL cannot be held responsible for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold. The same applies to any product modifications resulting from manufacturers. MCCP Distribution SARL's liability shall in any event be limited to the amount of the order, and shall not be held liable for simple errors or omissions which may have occurred despite all the precautions taken in the presentation of the products.
MCCP Distribution SARL publishes its Privacy Policy on its Site, which the customer accepts without reservation.
Applicable law and place of jurisdiction:
This contract is subject to Swiss law. In the event of a dispute, MCCP Distribution SARL reserves the right to choose the court of jurisdiction.
Other cases:
For all cases not governed by these conditions of sale, the Swiss Code of Obligations shall apply.
Payment methods
Credit cards: Customer orders can be paid for by Mastercard, VISA, Postcard or Twint. MCCP Distribution SARL uses secure data transfer procedures, particularly for credit card numbers. The customer is the owner of the products only from the day of their reception at the address communicated to MCCP Distribution SARL. The customer assumes all risks (in particular of loss, theft or deterioration) concerning the products delivered as soon as they are delivered to the address communicated by MCCP Distribution SARL. The order is payable when the information is entered on the Site by credit card via a secure server.
